On the initiative of KTZ liability for violation of railway safety rules has been tightened

On January 10, 2025, the President of Kazakhstan signed the Law "On Amendments and Supplements to the Code of the Republic of Kazakhstan on Administrative Offenses". The amendments, initiated by KTZ and law enforcement agencies, increase liability for violations related to railway safety and the rules for crossing railway crossings.
According to Article 559, penalties have been tightened for:
- Violation of the rules for the passage of horse-drawn carts (sleighs) and driving animals across railway tracks, as well as grazing livestock in the right-of-way of railways - the fine is 5 MCI or 19,660 tenge (with the MCI of 3,932 tenge for 2025). This article excludes such administrative penalties as a warning.
t also introduces liability for a repeat violation within a year. The fine is 10 MCI (39,320 tenge).
- Walking on railway tracks in unauthorized places - the fine is 3 MCI (11,796 tenge), and for the first time a fine is introduced for a repeat violation within a year - 5 MCI (19,660 tenge). Here, the administrative penalty measure of a warning is also excluded.
Road traffic accidents (RTA) at railway crossings remain an acute problem, often leading to forced emergency braking of trains. The main cause of RTA is gross violations by drivers of vehicles, including ignoring warning signs and signals.
According to Article 607, for violating the rules for crossing railroad crossings, including crossing tracks outside the crossing, driving onto a crossing when the barrier or prohibiting signal is closed, stopping at the crossing, the fine has been doubled to 20 MCI (78,640 tenge). For the first time, the article introduces a possible punishment - deprivation of the right to drive vehicles for up to nine months in cases where the violation leads to damage to vehicles or property.
